JUSTICE ARUN KUMAR ORAL ORDER 09-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Barauni P.S.Case No. 451 of 2017 registered under Sections 25(1-b) a, 26/35 of the Arms Act.

Allegation in brief is that police, in receiving information that two groups were fighting each other and making firing, reached there and recovered one country made pistol as well as one empty cartridge from the possession of the petitioner. Submission is that petitioner has been falsely implicated so one country made pistol is alleged to have been recovered without any live cartridges and the petitioner previously has no criminal antecedent and one another case i.e., Barauni P.S.Case No. 453 of 2017 under Section 307 of I.P.C. has been registered but there was no injury cause in that case.
