JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 06-06-2017 Heard Mr. Ajit Kumar, learned counsel appearing for the petitioner and the learned A.P.P. for the State. The petitioner in the present case is seeking regular bail in Jhajha P.S.Case No. 105 of 2016 under Section 364(A) of the Indian Penal Code.

The prosecution case, as alleged, would show that the father of the informant had gone to catch train for Hawrah but he did not return and the informant tried to contact with his father on mobile but the same was found switched off. It is further alleged that on the same night a message came on his mobile for a ransom of Rs.20 lacs in lieu of release of the father of the informant. The informant has not named this petitioner.

Patna High Court Cr.Misc. No.25318 of 2017 (2) dt.06-06-2017 2/3 Learned counsel for the petitioner submits that the petitioner has been remanded in the present case on 04.01.2017 from Barhat P.S.Case No. 65 of 2016. It is submitted that in the said Barhat P.S.Case No. 65 of 2016 he has already been enlarged on bail.

Submission of the learned counsel for the petitioner is that the name of the petitioner has transpired in the confessional statement of co-accused Amarjit Paswan, who has already been granted regular bail by a co-ordinate bench of this Court in Cr. Misc. No. 3418 of 2017. In para 14 of the application he has referred various orders passed by co-ordinate benches of this Court granting bail to similarly situated accused persons. Learned A.P.P. although attempted to oppose the prayer for bail,on specific query as to what is the difference in the case of the petitioner and that of those accused persons who have been enlarged on bail by the other co-ordinate benches of this Court, he could not be able to distinguish the present case. Considering the fact that other co-accused have been granted bail and the name of the petitioner has transpired in the confessional statement of co-accused Amarjit Paswan and Raju Yadav, who have already been enlarged on bail, I am inclined to grant bail to the petitioner.
