Thakur, learned advocate appearing on behalf of the petitioner, and learned A.P.P. appearing on behalf of the State.

The petitioner is seeking bail in Warisnagar (Mathurapur O.P.) P.S. Case No. 87/17 under Sections 420, 467, 468, 471 of the Indian Penal Code read with Sections 3/10 of Bihar Conduct of Examination Act, 1981 and Sections 65/66(c) of the Information Technology Act, 2000.

The allegations against the petitioner are that he was running a competition centre and was preparing the students for competitive examination. It is alleged that he had stolen the password of the concerned authority and prepared separate e-mail ID and filled up some forms of children. It is alleged that only 37 applications were filled up on-line but when the Admit Cards were

Patna High Court Cr.Misc. No.25309 of 2017 (2) dt.05-06-2017 2/2 received it was found that there were 47 excess Admit Cards apart from 37 original and those appeared to be a forged one. The learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent; he had gone for examination of his daughter at the centre and there is no cogent material to justify his continued detention in prison. On the other hand, learned A.P.P. submits that the petitioner was involved in act of cheating and forgery and was playing with the career of the young students. It is further submitted referring to the order passed by the learned 3rd Additional Sessions Judge, Samastipur which is the impugned order that the investigation in the present case is still going on. The petitioner was arrested only on 10.04.2017.

In the facts and circumstances stated above, considering that the investigation is still going on and the allegations against the petitioner are serious in nature, I am not inclined to grant regular bail to the petitioner at this stage. The prayer for bail is rejected.
