The petitioner seeks bail in a case instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Prosecution case, in short, is that 1769.400 liters wine is recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.01.2020 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that 1769.400 liters wine is recovered from the orchard. The orchard in question does not belong to the petitioner. The name of the petitioner has transpired in this case on secret information. The source of

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Darbhanga in connection with G.O. case No.909 of 2019 arising out of Keoti P.S. case No.134 of 2019.
