JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Sonbersa Raj (Kash Nagar O.P.) P.S. Case No. 12 of 2014 registered for the offences punishable under Sections 376, 341, 323, 504, 506/34 of the Indian Penal Code.

There is specific allegation against this petitioner that he established physical relation with the informant on false promise of marriage.

Therefore, considering the nature of allegation as well as submissions of the parties, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Sonbersa Raj (Kash Nagar O.P.) P.S. Case No. 12 of 2014 pending in the court of

Patna High Court Cr.Misc. No.1529 of 2015 (2) dt.16-01-2015 Chief Judicial Magistrate, Saharsa stands rejected. However, at the time of consideration of regular bail application of the petitioner, this order shall not cause any prejudice to the concerned court and the concerned court shall decide the regular bail application of the petitioner on its own merit.
