JUSTICE ARUN KUMAR ORAL ORDER 07-03-2018 Heard learned counsel for the petitioners as well as learned A.P.P. for the State.
The petitioners, already in custody, seek bail in connection with Khodawandpur P. S. Case No. 131 of 2016, registered under Sections 147, 148, 149 and 302 of the Indian Penal Code and 27 of the Arms Act.
Allegation in brief is that Rajeev Yadav, Lalan Yadav and Raju Yadav opened fire on the brother of the informant which hit him and fell down and Lakhindra Yadav gave a farsa blow on his head as a result succumbed to injuries. Learned counsel for the petitioners submits that the wife of the deceased has stated that Rajeev Yadav had shot at her
Patna High Court Cr.Misc. No.3145 of 2018 (3) dt.07-03-2018 2/2 husband and not stated about firing by others, where as learned counsel for the State submits that specific allegation is against these two petitioners of causing injuries by fire arm which was found on the person of the deceased and also one sharp cut head injury, attributed to petitioner No. 2, resulting into death. Having considered the said facts and circumstances, the prayer for bail of the petitioners stand rejected in connection with Khodawandpur P.S.Case No. 131 of 2016.
The court is directed to expedite the trial and preferably conclude the same by a year.
