The petitioner seeks bail in Nalanda P.S. Case No. 72 of 2014 registered under Section 392 of the Indian Penal Code. As per the prosecution case, motorcycle of the informant was looted by the motorcycle-borne criminals on the way to his house.
It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. Nothing incriminating article has been recovered from the conscious physical possession of the petitioner. The petitioner has been named in this case by coaccused Mukesh Kumar who has been enlarged on bail
Patna High Court Cr.Misc. No.26973 of 2017 (3) dt.21-06-2017 2/2 by Juvenile Justice Board. The petitioner is languishing in custody since 23.03.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Nalanda at Biharsharif in connection with Nalanda P.S. Case No. 72 of 2014.
