JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2019 This is an application for grant of anticipatory bail in connection with Dhoraiya P.S. Case No. 263 of 2018, disclosing offences under Sections 147, 341, 323, 307, 504 and 506 of the Indian Penal Code.

Allegation against the petitioners is of assault to the father-in-law of the informant and the specific allegation against one accused Mukesh Singh and the petitioner no.2 is of assault by Lathi.

Submission of the learned counsel for the petitioners is that there is a land dispute between the parties and falsity of the case will appear from the fact that the father is said to have

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Judicial Magistrate, 1st Class, Banka, in connection with Dhoraiya P.S. Case No. 263 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
