JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-03-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Sakra P.S. Case No. 542 of 2019 for the offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. In the instant case total 3.750 litres of foreign liquor was seized.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that the liquor was seized from the outside of back door of the house of the petitioner.

Considering the fact that the petitioner has got no criminal antecedent and the liquor was seized from the outside of back door of the house of the petitioner, the petitioner named

No.11536 of 2020(2) dt.04-03-2020 2/2 above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Muzaffarpur in connection with Sakra P.S.
