For the Petitioner/s : Mr. Shailendra Kumar Bhartee For the Respondent/s : Mr.
====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 22-02-2016 Heard learned counsel Mr. Mahendra Prasad Bharti for the petitioner and the learned counsel Mr. Dhananjay Kumar Tiwary, on behalf of the respondent.
The court below by the impugned order dated 29.01.2014, passed in Eviction Suit No. 06 of 2013 only directed the tenant-petitioner to deposit the arrears of rent at the rate of Rs. 1050/- per month and also current rate.
It appears that the Court below on the basis of materials produced before the Court recorded a finding that there is no relationship between landlord and tenant and then passed the order under Section 15 of the Bihar Building (Lease, Rent & Eviction Control) Act. Therefore, no case for interference in supervisory jurisdiction is made out.
Thus, this writ application is dismissed.
