Petitioner apprehends arrest in a case registered for the offences punishable under Sections 379/34 and other allied sections of the Indian Penal Code and 27 of the Arms Act. Prosecution's case, in brief, is that on the order of accused Dilip Thakur, the petitioner and two other persons surrounded informant's brother. Thereafter co-accused Anish Thakur and the petitioner caught hold him and co-accused Manish Thakur stabbed him and took away Rs.1500/- from the pocket of the victim.

Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. He sumits that in fact marpit had taken place in between Amit Kumar Tharur, brother of the informant and Mnish Kumar Thakur and the petitioner and other accused persons have falsely been implicated in the instant case. Further, there is no allegation of hurling knife blow against the petitioner. FIR has been lodged on 24.9.2019 for the occurrence of 17.9.2019, without any explanation of delay.

No.11411 of 2020(2) dt.25-06-2020 2/2 Considering the facts of the case, let the petitioner, above named, in the event of surrender before the Court below be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Benipatti Madhubani in Bisfi Police Station Case No. 288 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
