JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Magadh Medical P.S. Case No. 155 of 2014 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47 A of Excise Act.

Taking note of this fact that 15 litres mahua liquor were recovered from the house of the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, her prayer for anticipatory bail in connection with Magadh Medical P.S. Case No. 155 of 2014 pending in the court of Chief Judicial Magistrate, Gaya stands rejected. However, if petitioner surrenders before the court of Chief Judicial Magistrate, Gaya within four weeks from the date

No.614 of 2015 (2) dt.08-01-2015 of receipt/production of copy of this order to the concerned court and seeks regular bail, the learned Chief Judicial Magistrate, Gaya shall consider the regular bail application of the petitioner on its own merit without being prejudiced by this order, particularly, keeping in mind that petitioner is a lady and she does not have any criminal antecedent.
