JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 418,420 and 423 of the Indian Penal Code.
The prosecution case is that on 17.5.2010 the land of the complainant was transferred by co accused Mina Devi and Sanjiv kumar in favour of the petitioner when co accused Rohit Yadav is a witness to the saledeed.
It is submitted by the learned counsel for the petitioner that for the sale deed executed on 17.5.2010 the complaint was filed on 19.9.2011. The petitioner is a bonafide purchaser. Statement has been made in paragraph 3 of the petition that the
Patna High Court Cr.Misc. No.10583 of 2016 (2) dt.09-03-2016 2/2 petitioner has no criminal antecedent.
Considering the fact that the petitioner is a purchaser, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Khagaria, in connection with Complaint Case No. 938 C of 2011 subject to the conditions as laid down under Section 438(2) Cr.P.C.
