JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-07-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor representing the State of Bihar.

This application, for grant of anticipatory bail, arises out of Mahua Police Station Case No. 263 of 2016, disclosing offences under Sections 467, 468, 471, 406, 409, 420, 120B read with Section 34 of the Indian Penal Code. Learned Counsel for the petitioner has, at the very outset, drawn my attention to the order, dated 06.10.2016, passed in Criminal Misc. No. 38083 of 2016 and 26.10.2016, passed in Criminal Misc. No. 43438 of 2016, to submit that similarly circumstanced co-accused have been granted anticipatory bail by this Court. The petitioner, at the relevant point of time, was Mukhiya of the concerned Gram Panchayat and there is allegation of misappropriation of public money, meant for execution of

Patna High Court Cr.Misc. No.25350 of 2017 (2) dt.07-07-2017 2/2 works of MANREGA, during the financial year 2008-09, for which the First Information Report has been lodged in the year 2016.

Considering the above submission, this application is allowed.

Let the petitioner, Shakuntala Devi, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, at Hajipur, in connection with Mahua Police Station Case No. 263 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bond shall be liable to be cancelled.
