The petitioner seeks bail in connection with Manjhi P.S. Case No.302/2017 registered under Sections 30, 30(a) and 38 of Bihar Prohibition and Excise Act, 2016.

2034 liters of foreign liquor is said to have been recovered from the truck and nine accused persons were apprehended from the spot and rest accused persons fled away after seeing the police.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. The petitioner runs a construction company and he was a passerby from the place of

The petitioner has got no concern with the seized truck or liquor. One co-accused has been granted bail by learned court below though on the ground of heart disease. The petitioner has been languishing in custody since 28.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran, in connection with Manjhi P.S.
