Keeping in view the ratio of the decision rendered in the case of Kalika Singh and another vs. Awadhesh Narayan Singh, reported in 1993 BLJ 212, the learned single Judge has rightly allowed the writ application and set aside the order dated 20.12.2010 passed in Probate Case No.6 of 2010/17 of 2004. We do not find any infirmity in the order of the learned single Judge.

Appeal is dismissed.
