JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120(b)/34 of the Indian Penal Code and Section 27 of the Arms Act.

The first information report as well as relevant paragraphs of the case diary go to show that it were co-accused Murari Singh, Saroj Singh, Ram Bhoroshi Singh and Chanchal Singh, who opened fire on the deceased. So far as the petitioner is concerned, there is not even whisper about the presence of the petitioner over the place of occurrence when the occurrence took place.

Accordingly, petitioner, above named, is directed to
