Petitioner seeks regular bail in Lakshmipur P.S. Case No.115 of 2017 instituted for the offence under Sections 399, 402 of the I.P.C., Sections 25(1-b), a, 26, 35 of the Arms Act and 3⁄4 of the Explosive Substances Act.

Allegation against the petitioner is of recovery of one live cane bomb of 2 kg from his possession by the raiding party. It has been submitted by the petitioner that he has been falsely implicated in this as he was only one of the passerby at the place of occurrence. It has further been submitted that similarly situated co-accused has already been granted bail by coordinate Bench of this Court vide order dated 30.11.2017 passed in

Patna High Court Cr.Misc. No.3564 of 2018 (3) dt.12-02-2018 2/2 Cr.Misc.55568 of 2017 He is in custody since 26.06.2017 and he has no criminal antecedent.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the A.C.J.M., Jamui, in Lakshmipur P.S.Case No.115 of 2017.
