2. The petitioner apprehends his arrest in connection with Alamganj P.S. Case No. 894 of 2024 registered for offences under Sections 30(a)/32 of the Bihar Prohibition and Excise Act.

3. The petitioner is the owner of the scooty which was stolen from which recovery is of 150 litres of illicit country made liquor.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner claims clean antecedent. Petitioner has been made accused due to being owner of the scooty which was stolen.

5. Learned APP for the State has opposed the prayer for bail.

6. Considering the aforesaid circumstances, this application for anticipatory bail is allowed.

7. Accordingly, let the petitioner, above-named, in the event of his arrest or surrender within four weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court, Patna City/ concerned court below in connection with Alamganj P.S. Case No. 894 of 2024 subject to the conditions as laid down under Section 482 of the Code of Criminal Procedure.

8. Before accepting the bail-bond of the petitioner, the court below will verify the antecedent of the petitioner. If the petitioner is found having clean antecedent, the bail-bonds of the petitioner shall be accepted. If the petitioner is found having criminal antecedent(s), his bail-bonds shall not be accepted by the court below.
