JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 21-06-2017 Heard Mr. Bhola Prasad in support of the application seeking bail on behalf of the sole petitioner in connection with Janki Nagar P.S. case no. 102 of 2016, registered under Sections 341, 504, 506 386/34 of the IPC and Sections 25(1-b)a,26,35 of the Arms Act.

Earlier petitioner has approached this Court for grant of bail which was considered and rejected vide order dated 10.11.2016 (Annexure-1). The Court in the said order observed as under:- "Looking to the allegation and other materials reflected from the case records, I am not inclined to grant privilege of bail of the petitioner. Accordingly, the prayer for bail of the petitioner is rejected. However, the petitioner may have liberty to renew his prayer for bail after six months."

Learned counsel for the petitioner referred to

Patna High Court Cr.Misc. No.24800 of 2017 (2) dt.21-06-2017 2/2 Annexure-3 and submitted that co-accused Nitesh Kumar Yadav who was apprehended along with the petitioner has since been granted the privilege of bail. It is submitted that the case of the petitioner stands on identical footing.

Considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. Let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class Purnea in connection with Janki Nagar P.S. case no. 102 of 2016, subject to the following conditions:- (i) One of the bailors shall be the own/close family member of the petitioner.

(ii) No sooner the charges are framed the petitioner shall continue to appear before the Court below in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with.
