JUSTICE BIRENDRA KUMAR ORAL ORDER 28-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Sections 498A/304B/120B of the Indian Penal Code.
Having similar allegation father-in-law of the victim of dowry death has been allowed bail in B.P.No.107 of 2016 by the Court of learned 1st Additional Sessions Judge, Madhubani on 05.04.2016.
The petitioner is elder brother of the husband and prayer has been refused by learned Additional Sessions Judge-VI, Madhubani by the impugned order.
Considering the aforesaid fact, let the petitioner,
Patna High Court Cr.Misc. No.16987 of 2018 (2) dt.28-03-2018 P2/ above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bisfi (Patauna) P.S. Case No.87 of 2015, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
The District Judge, Madhubani, is directed to take appropriate steps so that such matter be heard by the same Court to avoid conflicting orders.
