JUSTICE PURNENDU SINGH ORAL ORDER 23-07-2025 Heard Mr. Amit Kumar, learned counsel appearing on behalf of the petitioner; Mr. Madhav Kumar, learned counsel for the O.P. No. 2 and Mr. Yogendra Kumar Singh, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Complaint Case No. 362 of 2023, registered for the offence punishable under Sections 406 and 408 of the Indian Penal Code.

3. As per the allegation made in the FIR, the petitioner had allegedly committed fraud by not returning a sum of rupees one lac to the complainant.

4. The parties have jointly informed that they are

5. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is ready to handover a cheque of rupees one lac to the complainant at the time of furnishing of the bail bond.

6. Considering the rival submissions made on behalf of the parties, I find that the parties may resolve their dispute amicably and in that view, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his/her arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrae, Samastipur, in connection with Complaint Case No. 362 of 2023, subject to the condition as laid down under Section 482(2) of the BNSS.
