The petitioner seeks bail in Special Case No. 187 of 2016 arising out of Gaurichak P.S. Case No. 295 of 2016 registered for the offence punishable under Sections 341, 342, 354, 354B, 34 of the Indian Penal Code and under Section 8 of the POCSO Act and Section 66 of the I.T. Act. It has been submitted on behalf of the petitioner that the petitioner runs a private coaching in the village. The reason of the dispute is that two boys who were not the students of coaching used to come at the coaching to meet the informant for which the petitioner objected and they also quarreled with the petitioner and warned him to face the consequence. It has been further submitted that informant was on intimate terms with

Patna High Court Cr.Misc. No.16380 of 2018(3) dt.13-04-2018 2/2 Vicky Kumar and Mukesh Kumar and in collusion with them made a false video to implicate the petitioner in a false case. Police has investigated the matter but none of the students of the coaching have made any adverse remarks against the petitioner. Petitioner has got no criminal antecedent and is in custody since 14.09.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Patna in connection with Special Case No. 187 of 2016 arising out of Gaurichak P.S. Case No. 295 of 2016.
