2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 103(1), 303(2) and 3(5) of the B.N.S.

3. The case of the prosecution, in short, is that wife of the informant was killed in suspicious circumstances. It is further alleged that cash and jewellery were also missing.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Leaned counsel for the petitioner has submitted that the F.I.R. was lodged against unknown miscreants. During Course of investigation, one Saif Ali was apprehended and he has given

No. 14148 of 2026(3) dt.16-04-2026 2/3 his confessional statement wherein he has stated that he was having relationship with the deceased and that he has pressurized her to come with cash and jewellery. Saif Ali was running away after collecting the cash and jewellery, he was seen by the deceased and she started raising alarm. He committed murder by throttling and hided himself in a hotel. He has further stated that he has concealed the cash and jewellery in the furniture shop of this petitioner. Learned counsel for the petitioner has further submitted that only allegation against the petitioner is that the cash and jewellery which was taken away by the main assailant Saif Ali, was concealed in his shop which was recovered therefrom.

It has further been submitted that the role of this petitioner in committing murder of the deceased is not there. Only role attributed to this petitioner is that the cash and jewellery was concealed in his shop. The main thrust of allegation is against Saif Ali. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 26.11.2025.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is

The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Siwan in connection with Barharia P.S. Case No. 557 of 2025.
