JUSTICE ARUN KUMAR ORAL ORDER 30-03-2018 Heard learned Counsel for the petitioners and the State. Petitioner, already in custody since 16.2.2018, seeks bail in Kothi PS Case No. 60 of 2017 registered under Sections 147, 148, 149, 341, 342, 452, 323, 324, 325, 326, 354(B), 307, 337, 427, 379, 504 and 506 of the IPC and Sections 3⁄4 of Witch Practices Act. The allegation in brief is that large number of villagers assaulted the informant and looted some house hold articles alleging her practicing witchcraft.

Learned Counsel for the petitioners submits that the allegation is general and omnibus against large number of villagers and there is no specific allegation against the petitioner. Having considered the said facts and circumstances, the petitioners, namely, Mukesh Kumar @ Mukesh Prasad, Dinesh Prasad and Rakesh Prasad are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by each one of them with two sureties of the like amount each to the satisfaction of ACJM Sherghati, Gaya in connection with Kothi PS Case No. 60 of 2017.
