====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 17-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Naubatpur P. S. Case No.606 of 2020, instituted for the offences under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act. From bare perusal of the allegation in the F.I.R., it would manifest that petitioner along with other co-accused was caught hold while they were assembled to commit dacoity and they were apprehended by the police. From the possession of this petitioner one countrymade loaded pistol, a mobile and a motorcycle were recovered.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.24204 of 2021(2) dt.17-11-2021 2/2 petitioner is innocent and he has been falsely implicated in this case. He is in custody since 04.12.2020 and charge-sheet has been submitted against him. Learned counsel further submits that the motorcycle belonged to the petitioner and same has been released in favour of the him.

Learned A.P.P. vehemently opposes the bail prayer. Considering the facts afore-stated, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Danapur, Patna in connection with Naubatpur P. S. Case No.606 of 2020.

The application stands allowed.
