The petitioners seek bail in Benipatti P.S. Case No. 07 of 2015 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
Allegation against the petitioners is of committing murder of the sister of the informant.
It has been submitted on behalf of the petitioners that the petitioners have been falsely implicated in this case. It has further been submitted that the petitioners are Mother-in-Law and Gotni of the deceased and were living separately with the deceased. In the post mortem report the doctor has opined the cause of death due to Asphyxia smothering. Petitioners have got
Patna High Court Cr.Misc. No.3328 of 2018(3) dt.13-02-2018 2/2 no criminal antecedent and are in custody since 02.11.2017. Considering the aforesaid facts and circumstances of the case as well as the fact that the petitioners are lady, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Benipatti, Madhubani in connection with Benipatti P.S. Case No. 07 of 2015.
