JUSTICE SHIVAJI PANDEY ORAL ORDER 13-11-2020 Heard learned counsel for the petitioner and learned counsel for the State through Video Conferencing. In this case, the petitioner is seeking regular bail in connection with G.R. No. 1476 of 2019, Nabinagar P.S. Case No. 304 of 2019 registered for offence punishable under sections 20(b) (ii) (B) of the N.D.P.S. Act and sections 224, 225, 353/34 of the Indian Penal Code and section 30 of the Bihar Prohibition and Excise Act, 2018.

The police received a secret information that the brothers of the petitioner are engaged in selling liquor and narcotic. Raid was conducted and the police recovered 3.1 Kg. of Ganga and 67 litres of liquor from the joint house of the petitioner. From the exclusive possession of the petitioner, police recovered 400 grams of Ganga and 7.5 litres of country

Patna High Court CR. MISC. No.19206 of 2020(4) dt.13-11-2020 2/2 made liquor. The petitioner is in custody since 05.01.2019. The petitioner has one criminal antecedent relating to violation of the Excise Act.

Looking to the entirety of the fact, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 7th Additional Sessions Judge-cum-Special Judge (Excise), Aurangabad in connection with G.R. No. 1476 of 2019, Nabinagar P.S. Case No. 304 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. If the petitioner is found to be involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of his bail bond and the court below will pass an appropriate order.
