JUSTICE ARUN KUMAR ORAL ORDER 19-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Lalganj PS Case No. 118 of 2017 registered under Sections 302/34 of the IPC and Section 27 of the Arms Act.

The allegation is that Sonu Kumar, who was a pillion rider of the motorcycle being driven by some other person, shot at informant's brother due to enmity on account of not supporting his aunt in panchayat election.

Submission is that the petitioner is not named in the FIR, though the petitioner is said to be acquainted with the informant he only suspects involvement of the petitioner only on the basis of recovery of a slipper. However the specific allegation of making firing and killing the informant's brother is against Sonu and the petitioner has no criminal antecedent. The police has submitted charge-sheet in this case.

Having considered the said facts and circumstances, the petitioner, namely, Prmod Tiwari @ Kargil is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Vaishali at Hajipur in connection with Lalganj PS Case No. 118 of 2017.
