JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-07-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No.446C of 2017, disclosing offences under Sections 498A and 323 of IPC and Section 3⁄4 of Dowry Prohibition Act.

Allegation as per complaint petition lodged by the complainant against the petitioner, who happens to be the husband of the complainant that after marriage at the instance of the sister-in-law, accused persons started torturing her and it is also alleged that sister-in-law has been told by a Sadhu to torture her. Further allegation is that mother-in-law of the petitioner used to confine her in a room and against this petitioner there is allegation of assaulting her in a drunken condition. There is also

Patna High Court CR. MISC. No.16290 of 2019(7) dt.16-07-2019 2/2 allegation for demand of Rs.50,000/-.

Submission of the learned counsel for the petitioner is that he is still ready to keep her with dignity and care and all the allegations are false and concocted and the main allegation against the mother-in-law and sister-in-law.

Earlier notice was issued to the opposite party no.2, the same was received by her mother, but in spite of that, nobody appears on behalf of opposite party no.2. Having heard both sides, considering the above submission, this application is allowed. The provisional bail granted to the petitioner, vide order dated 15.03.2019 is confirmed.
