JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-03-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sessions Trial No. 69 of 2017/ 53 of 2017 arising out of Gaya Muffasil P.S. Case No. 274 of 2016 for the offenses under Sections 395 and 412 of the Indian Penal Code. It appears that the petitioner is involved in certain other cases and considering the aforesaid his application for bail was earlier rejected vide order dated 23.1.2018 passed in Cr. Misc. No. 53213 of 2017.
Learned counsel for the petitioner submits that petitioner is in custody since 20.07.2016.
Considering the fact that the petitioner is in custody
Patna High Court CR. MISC. No.13058 of 2019(2) dt.06-03-2019 2/2 since 20.7.2016 i.e. about 2 1⁄2 years, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Gaya in connection with Sessions Trial No. 69 of 2017/ 53 of 2017 arising out of Gaya Muffasil P.S. Case No. 274 of 2016, subject to the condition that the petitioner will extend full cooperation in the disposal of the case. In the event, any attempt is made to delay the conclusion of the trial or cause any prejudice to the prosecution case or influence the witnesses, the court below shall be at liberty to cancel the bail bonds of the petitioner.
