JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-07-2017 The petitioner seeks bail in connection with Araria P.S. Case No. 856/2016 registered for offences punishable under Sections 302 and 201 of the Indian Penal Code. The allegation against the petitioner is that before the death of the deceased, he had used his ATM card for purchasing ornaments.

It has been submitted on behalf of the petitioner that he is innocent and has not committed any offence. It is further submitted that the deceased had himself given him his ATM card for withdrawing money from the Bank and in the meantime the deceased was killed. The petitioner has been made accused only on suspicion. The petitioner is in custody since 28.12.2016. Having heard learned counsel for the parties, in view

Patna High Court Cr.Misc. No.24881 of 2017 (3) dt.10-07-2017 2/2 of the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. However, considering the fact that petitioner is in custody for about 7 months, learned Chief Judicial Magistrate, Araria is directed to expedite the commitment of the case and after commitment dispose of the same within a period of 9 months from the date of commitment.

With the above observation, this application is dismissed.
