JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 The appellant seeks regular bail in connection with Sahkund P.S. Case No. 02 of 2017, registered for offences punishable under Sections 302, 201/34 of Indian Penal Code and Section 3(2)(v) of SC/ST Act.
Allegation against the appellant that he along with others killed the son of the informant.
It has been submitted on behalf of the appellant that save and except suspicion, there is nothing against the petitioner. Further it is alleged that the deceased had illicit relations with the wife of one Vijay Sharma and petitioner has nothing to do with the alleged offence. It has also been submitted that appellant is aged about sixty years and has been in judicial custody since 06.03.2017.
Patna High Court CR. APP (SJ) No.1590 of 2017 (4) dt.24-08-2017 2/2 Learned Special P.P. opposed the prayer for bail. Having heard both sides, considering the fact and circumstances of the case and serious nature of allegation, I am not inclined to release the appellant on bail, this appeal for regular bail is accordingly dismissed.
However, considering the fact that appellant is an old aged person, the trial court is directed to expedite the trial and try to conclude it within a period of seven months even by conducting the trial on day to day basis.
At the same time S.P. Bhagalpur is also directed to ensure the production of witnesses in the court below so that the trial can be concluded within the stipulated time.
