Mr. Rana Randhir Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-01-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with Jokihat P.S. Case No. 410/2019 registered for the offences punishable under Sections 341/323/354(B)/379/447/448/504/ 506/34 of the Indian Penal Code.
As per the prosecution case, all the petitioners and other FIR named accused persons came to the courtyard of the informant and misbehaved with the daughter of the informant and assaulted her with slaps and sticks.
It is submitted on behalf of the petitioners that the present case is counter blast of earlier case filed by the petitioner No. 1 i.e., Jokihat P.S. Case No. 409 of 2019 on 24.11.2019. It is further submitted that both sides have sustained
Patna High Court CR. MISC. No. 33604 of 2020(4) dt.18-01-2021 3/3 injuries. There is general and omnibus allegation against all the petitioners.
Considering the aforementioned facts and circumstances, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Jokihat P.S. Case No. 410/2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
