The petitioner is apprehending his arrest in a case under Section 307 and other sections of the Indian Penal Code. The informant made a very specific allegation that on some altercation, Dablu Kumar assaulted the informant Birendra Ram and Jitendra Ram assaulted the brother of the informant Ravindra Ram with lathi on his head. Other accused persons are alleged to have assaulted the informant and Ravindra Ram indiscriminately thereafter. Only one injury was found on the body of each of the informant and Ravindra Ram. The petitioner Kamlesh Ram has not specifically alleged to have assaulted anybody.

Having considered the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the

Patna High Court Cr.Misc. No.2446 of 2015 (2) dt.20-01-2015 2/2 learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in Sandesh P.S. Case No. 71 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
