2. The petitioner seeks bail in connection with Madhepur P.S. Case No.294 of 2023 instituted for the offences under Sections 413 of the IPC and 25(1-b)a, 26, 35 Arms Act.

3. Prosecution case, in short, is that during vehicle checking police caught the motorcycle, upon which three persons were travelling including the petitioner. They trying to run away, but after interception they caught. After interrogation they disclosed their names and after search one Desi Katta and two live cartridges were recovered from the house of the coaccused.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the

Further submits that petitioner is a student and for the purpose of attending the class he is going to coaching and there is no recovery from the conscious possession of the petitioner. Charge-sheet has been submitted. Petitioner is in custody since 25.11.2023 and has no criminal antecedent.

5. Learned APP for the State has vehemently opposes the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of court below/concerned court in connection with Madhepur P.S. Case No.294 of 2023.
