JUSTICE PRABHAT KUMAR JHA ORAL ORDER 14-01-2015 Heard learned counsel for the petitioner, State as well as learned counsel for the informant.

The petitioner is the husband and apprehends his arrest in Complaint Case No. 612 (C) of 2013, registered for the offences punishable under Sections 323, 498A, 370, 504 and 34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

Learned counsel for the complainant submits that the complainant is ready to live with her husband, provided, her husband gives undertaking to keep her with honour and dignity. Learned counsel for the petitioner submits that the petitioner is ready to keep his wife.

Patna High Court Cr.Misc. No.1565 of 2015 (2) dt.14-01-2015 Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged provisionally on bail for two months on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties to its own satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Complaint Case No. 612 (C) of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and the court below shall take all efforts for reconciliation, if the dispute is resolved the court below shall confirm the provisional bail and if the dispute is not resolve the court below shall pass order in accordance with law without being prejudiced by this order.
