JUSTICE S. KUMAR ORAL ORDER 31-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 272, 273, 308 and 34 of the Indian Penal Code and 30 and 38 of the Bihar Prohibition and Excise Act. Allegation against the petitioner is that while he along with another accused was coming on a motorcycle with country made liquor, they were apprehended by police. It has been submitted on behalf of petitioner that he has got no criminal antecedent. He has falsely been implicated in the present case. Nothing has been recovered from his possession. The alleged motorcycle does not belong to him and he has no concern with accused Nizamuddin Ansari. He is languishing in jail custody since 01.04.2017.

Considering the facts and circumstances of the present case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XII, Siwan, in connection
