Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Kankarbagh P.S. Case No. 172 of 2018 lodged under Sections 302/34 of the I.P.C.

As per the prosecution case, the informant has disclosed that marriage of his daughter was solemnized with the petitioner on 08.06.2009. Allegation was there that behaviour of the in-laws family members of the informant's daughter were not proper with her. Further allegation is that in the year 2012, the petitioner called his wife and started demanding 4 lakh

Patna High Court CR. MISC. No. 13334 of 2022(6) dt.21-12-2022 2/3 rupees from her. The allegations of physical torture and not providing food to the informant's daughter are also there. Informant further alleged that at social level, he had tried his best to resolve the issue but he failed. It has been alleged that in the year 2017, the informant's daughter started residing with the petitioner at Patna but here also, he used to torture her. Informant further disclosed that her daughter called her father that petitioner was again torturing and assaulting her and also not providing food to her. On the date of lodging the F.I.R., when the informant reached at the quarter of his daughter he found that it was locked. When he reached Kankarbagh police station, he found the dead-body of his daughter. With this allegation, the present case has been filed against the petitioner and his sister.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 18.11.2021. Charge sheet has already been filed in this case. Upon specific query that whether charge has been framed or not, Learned counsel for the petitioner submits that as per his knowledge charge has been not framed in this case.

Learned counsel for the petitioner submits that the

He further submits that case diary as well as viscera report have been called for. Learned counsel for the petitioner submits that in viscera report, nothing adverse has been found. Learned counsel for the State opposes the prayer for bail and submits that it is a case in which husband is accused and wife is deceased.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail. Liberty is hereby granted to the petitioner that he may renew his prayer for bail 6 months after framing of charge. Trial Court is directed to release the petitioner on bail, imposing its own conditions, so that he may not evade his appearance during trial.
