The petitioner has preferred this application for grant of regular bail in a case registered under section 379 of the Indian Penal Code.
As per the prosecution case, the motorcycle of the informant was stolen and was not to be found inspite of search. It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. Referring to the order of the learned Court below rejecting the application for bail of the petitioner it is submitted that from the same it would transpire that the material being relied on against the petitioner is the tower location of his mobile phone and his criminal antecedent. No incriminating article has been recovered from
Patna High Court CR. MISC. No.25105 of 2021(2) dt.22-11-2021 2/2 his possession. The petitioner is in custody since 22.9.2020 and charge sheet has been submitted in the case.
Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Ramnagar P.S. Case no. 112 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Bagaha, West Champaran.
