The petitioner apprehends his arrest in Makhdumpur P.S. case No. 6 of 2019 (Excise case No. 25/ 2019) registered under Section 30(a) of Bihar Prohibition & Excise Act. The S.H.O., Makhdumpur got secret information that Manoj Kumar had kept liquor in his house and on such house of Manoj Kumar situated in village Malahi was searched and huge quantity of IMFL of different brands was recovered. Manoj Kumar disclosed that petitioner and Anant Gopal are owner of the liquor who had kept the liquor in his house. The learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. Manoj Kumar, his co-villager, has falsely implicated

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-cumSpecial Judge, Excise Act, Jehanabad in connection with Makhdumpur P.S. case No. 6 of 2019 (Excise case No. 25/ 2019), subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
