====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 17-11-2021 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner seeks bail in connection Rajgir P.S. Case no. 290 of 2020 registered for the offence punishable under section 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 04.09.2020, charge sheet has been submitted and petitioner is person with clean antecedent. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the FIR, it would manifest that informant has alleged that during course of checking, a blue colour Apatche motorcycle was coming from Rajgir Kund side with two persons. They were apprehended and they disclosed their names as Kamlesh Kumar (petitioner) and Rahul Kumar

Patna High Court CR. MISC. No.24228 of 2021(2) dt.17-11-2021 2/2 and they were unable to produce any document relating to vehicle. It was found that the said motorcycle belonged to Roshan Kumar, Jehanabad. He further submits that co-accused Rahul Kumar has been granted bail by this court vide order dated 03.03.2021 in Cr. Misc.no. 1019/2021.

Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody since 04.09.2020, charge sheet has been submitted, he is a person with clean antecedent and co-accused has been granted bail, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsarif in Rajgir P.S. Case no. 290 of 2020.
