This is the second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier bail application of the petitioner was dismissed vide order dated 07.12.2020 passed in Cr. Misc. No. 32719/2020.
The allegation against the petitioner is that the petitioner assaulted the uncle of the informant with Farsa on his head due to which he died during course of treatment. Learned counsel for the petitioner submits that there is a case and counter case between the parties and the dispute has arisen between them on the point of cutting of bamboos. Regards being had to the submissions made by the parties and taking into consideration the fact that this is the second attempt for bail on behalf of the petitioner, he is at an advanced age of 80 years and remained in custody since 10.05.2020, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, namely, NATHUNI RAM be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st Bagaha, West Champaran in connection with Semara PS Case No. 32/2020.
