1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 310(2) of the BNSS.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that he was intercepted by unknown criminal who looted Rs.2,75,000/- which he had withdrawn from CSP and also assaulted him by butt of gun causing injury on head, further he bite one accused on his finger.

4. The learned counsel submits that the F.I.R. is against unknown and the name of the petitioner transpired in the confessional statement of apprehended accused in police

On query of the Court that as to what the petitioner does, the learned counsel for the petitioner submits that he has instruction to make submission that petitioner is a teacher in a school and he teaches students, on which, the learned APP submits that though the said submission has been made but then the same has not been pleaded in the anticipatory bail application, as such opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on provisional anticipatory bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Garkha P.S. Case No.680/2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

6. Further, one of the bailors of the petitioner shall be his father namely Sunil Nut.

7. It is made clear that thereafter the petitioner will submit his teaching certificate from the school where he teaches

No.12872 of 2025(2) dt.02-04-2025 3/3 and the learned trial court thereafter shall verify the said certificate from the concerned school and in the event if it is found that the certificate submitted by the petitioner is genuine, in that event, the provisional anticipatory bail of the petitioner shall be confirmed forthwith but if after inquiry it is found that the certificate submitted by the petitioner of the school is forged, fabricated or not a genuine document, in that event, the provisional anticipatory bail shall be cancelled forthwith.
