The petitioner is in custody since 11.04.2016 in connection with Daraundha P.S. Case No. 297 of 2015 for the offence punishable under section 394 of the Indian Penal Code. Allegation against the petitioner is that he was involved in the road robbery. The case was registered against unknown. The informant has claimed that he can identify the miscreants, yet the petitioner was not put on Test Identification Parade. It appears from Anenxure-2 to this petition that similarly circumstance co-accused was granted bail by a coordinate Bench of this Court in Cr. Misc. No. 43443 of 2016 vide order dated 08.12.2016.

Patna High Court Cr.Misc. No.27027 of 2017 (3) dt.06-07-2017 2/2 Considering the facts and circumstances mentioned above that similarly circumstance co-accused was granted bail by a coordinate Bench of this Court in Cr. Misc. No. 43443 of 2016 on 08.12.2016, I am inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VIII, Siwan or Successor Court in connection with Daraundha P.S. Case No. 297 of 2015, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and he will not, in any manner, influence the witnesses.
