2. The petitioner apprehends his arrest in connection with Maner P.S. Case No. 296 of 2024 for the offence registered under Sections 341, 323, 379, 307, 504, 506/34 of the I.P.C. lodged on 09.05.2024 by the informant Sima Kumari .
3. As per prosecution story, the informant alleged that she was fed up with the attitude of the accused side and had moved out to a different place residing as a tenant. However, their attitude did not change and she regularly approached the police officials who failed to look into the matter which resulted into the present occurrence in which the petitioner along with his family members assaulted each and every family members
Patna High Court CR. MISC. No.12906 of 2025(3) dt.14-05-2025 2/2 of the informant including the 75 years old father-in-law to an infant. This led to the FIR.
4. Learned counsel for the petitioner submits that he is a student, there is second version to this story vide Maner P.S. Case No. 297 of 2024 lodged by the petitioner's side alleging assault.
5. Learned counsel for the informant has filed a counter affidavit annexing the different photographs to show the assault theory in which the father-in-law is having a plaster on his left hand, the husband is having injury on his head while the child is also having injury.
6. Considering the assault that has taken place against the informant side and the entire story as it unfold that she was complaining before the said occurrence about the regular threatening of the accused, in that background, no relief can be granted.
