The petitioner has prayed for bail in connection with Minapur P.S. Case No. 595 of 2019 registered for the offence punishable under sections 395 of the Indian Penal Code. As per allegation in the FIR, while the informant was returning to his home, six accused persons are said to have stopped the vehicle of the informant surrounded him and snatched his motorcycle on pistol point.

It is submitted by learned counsel for the petitioner that from the order of the learned court below it appears that the name of the petitioner has transpired in the confessional statement of co-accused. No incriminating article has been

Patna High Court CR. MISC. No.13560 of 2022(3) dt.02-01-2023 2/2 recovered from the constructive possession of the petitioner. Petitioner is in custody since 16.03.2021.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, 20th, Muzaffarpur in connection with Minapur P.S. Case No. 595 of 2019.
