Petitioner seeks regular bail in a case registered for the offences punishable under Sections 406,420,467,468,120B,34 of the IPC and Section 138 of N.I. Act and Section 3 B.P.I.D. (in Financial Establishment) Act, 2002.
The main allegation of persuasion of the informant in depositing money in Mutual Benefit Ltd. is against co-accused Gaurav Kumar who has been already allowed regular bail by coordinate Bench of this Court vide order dated 30.03.2018 passed in Cr. Misc. No. 11253 of 2018.
Allegation against the petitioner is that he was Director of the said company and the refund cheque issued by
Patna High Court Cr.Misc. No.22957 of 2018(2) dt.20-04-2018 2/2 the company is signed by the petitioner. He is in custody since 24.11.2017. Investigation of the case is already completed. Considering the entire facts and circumstances of the aforesaid case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 20,000/- (Rs. Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Waris Nagar P.S. Case No. 254 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
