2. The petitioner is in custody since 30.10.2019 in connection with Kudhni P.S.Case No. 712 of 2019 for the alleged offences under Sections 399 and 402/34 of the Indian Penal Code and Section 37(c) of the Bihar Prohibition and Excise Act, 2016.

3. It is submitted that the petitioner has been falsely implicated in connection with having been found in drunken condition and his name surfaced on the basis of confessional statement of co-accused Santosh Sahni. The petitioner claims clean antecedents.

4. Learned APP appears and has been heard.

5. Be that as it may and having regard to the period of custody already suffered since 30.10.2019, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each

Patna High Court CR. MISC. No.16908 of 2020(2) dt.14-05-2020 2/2 to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Kudhni P.S. Case No. 712 of 2019, corresponding to G.R. No. 2095 of 2019, if he is not otherwise required in any other case.
