The petitioner is in custody in connection with NDPS Case No. 17 of 2017 arising out of NCB Crime No. 19 of 2017 registered for the offences under Sections 8,20(b)(ii)(c), 25 and 29 of the NDPS Act.

Learned senior counsel appearing on behalf of the petitioner would submit that the petitioner has no criminal antecedent. He has approached this Court for bail earlier but the same was rejected with the direction to the Court below to expedite the trial and conclude the same within a period of nine months but the same has not been concluded as yet. The

Patna High Court CR. MISC. No.11891 of 2020(4) dt.03-07-2020 2/2 petitioner is in custody since 21.9.2017.

Considering the aforesaid, the present application is disposed of with direction to the trial court to conclude the trial within a period of six months from today.

In the event the trial is not concluded within six months and if there is no fault on the part of the petitioner in conclusion of the trial, the court below shall release the petitioner on bail on completion of six months from today. With the aforesaid, the present application stands disposed of.
